An application for a take-out restaurant opened a discussion about zoning at the planning board meeting Monday, Nov. 21.
Morris Plains businessman Zhao Fan must appeal to the borough board of adjustment to get permission to open a take-out restaurant near the train station.
Zhao Fan wants to operate a primarily take-out Mexican restaurant on Speedwell Avenue. He was advised by the planning board on Monday, Nov. 21, his change of use variance needs to be heard by the other board.

Parking is the only consideration. Zhao said because the restaurant will be almost entirely take-out he will not need as many spaces as are required in the ordinance. But the parking discussion brought up the fact the parking behind the building is in a residential zone while the building itself is in a business zone. The off-street parking is shared by a Chinese restaurant, a tax-preparer’s office and an apartment.
Board member and Councilman Ray Zabihach said the parking behind the building is in a residential zone because the back of the property faces Allen Street which is a residential street. Druetzler said the zoning should follow the property line.

Zabihach said Borough Planner William Denzler should determine if there are other inconsistencies between a building and its parking and the planning board can make a recommendation to council.
Meanwhile, Zhao will go to the board of adjustment for a variance so he can open is restaurant.
