Lawsuit Claims Morris Plains Ignored Affordable Housing Law

M&M seeking court approved builder's remedy on 63-acre property.

The developer of a proposed 800-unit residential complex in Morris Plains is suing the borough for allegedly failing to meet state obligations to provide affordable housing, according to Law360. The lawsuit was filed in Morris County Superior Court on Jan. 29, Law360 reported. M&M Realty Partners purchased land in August on the former Pfizer property to develop a mixed residential and retail complex. A representative of the Morris School District Board of Education said the complex had the potential to increase the borough's population by 25 percent. The plans for a strip mall less than a mile from the existing Main Street businesses in Morris Plains shows the developers are already in contempt of the current residents and small business owners in Morris Plains. 800 units with 800 parking spaces is another disaster waiting to happen. Atlantic Health to Deed Restrict 19 Affordable Housing Units

Planning Board agreed to adjust condition of nearly decade-old approval.

Nineteen is better than nothing. That was the point being presented to the Planning Board Thursday night when the attorney for Atlantic Health System—the parent company of Morristown Medical Center—presented the board with a proposal that would see 19 already-built residences become affordable housing units. The compromise stems from approvals in 2004 and 2005 by the town which saw additions to the Carol G. Simon Cancer Center and the JCP&L parking garage. As part of those approvals, AHS would provide an affordable housing component in nearby Franklin Village, which the company owns. Affordable Housing Fight Goes Back to the Courts

Housing advocate and municipalities try to prevent the state from taking their funds.

The battle between the Christie administration and the Fair Share Housing Center continues. This time, the two sides are going to court Friday over as much as $200 million in local affordable housing trust funds. So far, the Appellate Division of Superior Court has been kind to the Cherry Hill-based housing advocates, but this case could be a different story. To help balance the budget, Gov. Chris Christie recommended the state use the trust fund money. The administration appears to be within its legal right to do so, as the law creating the funds—and the developer fees that municipalities levy to subsidize them—specified municipalities had to “commit to spend” the money within four years. Pre-applications are now available for moderate income units in Morris Township, for those who qualify. The press is below. The Housing Partnership, administrative agent for the for-sale income restricted units in the Township of Morris, has announced that they are accepting pre-applications for the interested parties pool for one and two bedroom moderate income “affordable” units in the Township of Morris. Taxes and condo fees are at a reduced rate for these units. A single person or a couple is eligible to apply for a one-bedroom; a single parent or couple with one or two children of the same sex may submit a pre-application for a twobedroom unit. United Way to County: Use It or Lose It

Affordable housing money in danger of being seized by state.

The United Way of Northern New Jersey is asking Morris County governing bodies to protect $22 million in funds earmarked for affordable housing, so that the state doesn't take the money back.
